Terms & conditions

These terms ("terms") govern your use of pulsark.app and the Pulsark beta. Please also read our privacy policy, which explains how we handle your data. In short: the beta is early software provided as is, the music you make is yours, and you can leave the mailing list anytime.

Agreement to these terms

By using pulsark.app or joining the Pulsark newsletter or beta, you agree to these terms. If you do not agree, please do not use the site or the beta. Your use of the released app is additionally governed by Apple’s App Store terms.

The app and the beta

Pulsark is an iPad application under active development. Pre-release beta builds are distributed through Apple TestFlight and are provided on an "as is" and "as available" basis. Features may change, break or be removed before launch, and availability is not guaranteed.

Newsletter and updates

If you submit your email, you consent to receive occasional launch news and product updates. Every email includes an unsubscribe link, and you can opt out at any time. Our privacy policy explains how we store and use your email.

Beta testing

Beta builds are for evaluation and feedback. Do not rely on them for critical or professional work, and keep your own backups of any projects, samples or sound banks — pre-release data formats may change and are not guaranteed to migrate to later versions.

Your content

The samples, sound banks, patterns and music you create with Pulsark are yours. We claim no ownership of them. You are responsible for holding the rights to any audio you import, record or distribute, and for how you use what you make.

Acceptable use

Use the site and app lawfully. Do not attempt to disrupt, attack or gain unauthorised access to our services, and do not use the beta to infringe others’ rights. We may suspend access that threatens the service or other users.

Intellectual property

Pulsark, the Pulsark name and mark, the website and its content are owned by Stig H. Våge. Third-party components — such as AudioKit and Ableton Link — remain the property of their respective owners and are used under their licences.

Disclaimers

The site, the beta and the app are provided without warranties of any kind, to the fullest extent permitted by law. We do not warrant that they will be uninterrupted, error-free or fit for a particular purpose.

Limitation of liability

To the extent permitted by law, we are not liable for any indirect, incidental or consequential loss, or for lost data, arising from your use of the site, the beta or the app. Nothing in these terms limits liability that cannot be limited under Norwegian law.

Pricing and purchases

Pulsark is free during the beta. Final pricing will be announced before launch. Any purchase of the released app is made through the App Store and governed by Apple’s terms; we do not process payments directly.

Changes to these terms

We may update these terms as the product and its launch evolve, and will publish changes on this page with a new "last updated" date. Continued use after changes means you accept the updated terms.

Governing law

These terms are governed by the laws of Norway, without prejudice to any mandatory consumer protections you have where you live.
